A personal injury is defined as either a physical injury, disease or illness, or a psychological injury/ condition that has been caused by someone else’s fault or negligence. In some cases, it may result in death giving rise to a fatal accident claim. If you were involved in an accident or you suffered from personal injuries that were caused by someone else, contact our personal injury solicitors for initial consultation and advice.

As well as the physical aspects of a personal injury, many people also have to deal with the ongoing impact of the injury on their everyday lives. A personal injury can result in absence from work, the need for care and ongoing medical treatment. Because of this the thought of starting a compensation claim for personal injuries can often be a stressful and daunting process. A personal injury will be detrimental to the quality of life of the injured person, either temporarily throughout the healing process, or permanently in cases of severe life changing injuries or catastrophic injuries. Our personal injury solicitors will advise you in practical and straightforward ways, and advise you on all of the options available to you. We will support you through the process and fight to get the maximum compensation you deserve.

This personal injury may have been caused by:

  • car or road traffic accidents – as a driver, cyclist or pedestrian
  • accidents at work
  • accidents in a public place (public liability)
  • accidents in others’ premises (occupier’s liability)
  • accidents on holiday
  • injuries caused by negligence during hospital or medical treatment

Making a personal injury claim:

At Oasis Law solicitors, we have solicitors who are specialists in personal injury. They will guide you through the process of making a personal injury claim and your case handler will be available to you throughout your case. To make a personal injury claim, we will

  • Carry out a free initial consultation. We will ask you about what has happened, the injury and assess the best way to help you.
  • Contact the insurers of the party who was at fault for your accident to seek their agreement to fund early rehabilitation and also seek an admission of liability.
  • Seek an early interim payment to help relieve any financial pressure and to fund medical and rehabilitation treatment as well as expenses whilst we finalise your claim.
  • If they do not accept responsibility, we will gather additional evidence to prove their fault. Evidence will also be needed to support your claim for damages: this can include independent medical expert evidence, witnesses who can attest to how much help you have needed after the accident, and anyone else we feel would support your case.
  • If your claim is successful we will fight to get the best possible compensation that you deserve. You’ll then receive your compensation.

Generally, you have three years from the date of an accident through negligence to make a personal injury claim.
In Personal injury, compensation is assessed in two ways.  We have the General Damages which is the actual injury element of the compensation and the Special Damages which is the financial losses that flow from the injury. General damages are therefore, the compensation for the physical and/or mental pain and suffering, disfigurement or impairment, and lowered quality of life (due to physical and mental limitations, such as no longer being able to undertake previous favourite sports or hobbies). At Oasis Law Solicitors, we refer to this as Pain, Suffering and Loss of Amenity (PSLA). We will collate all the medical and supporting evidence to prove this as part of your claim. Special damages on the other hand, is the compensation for the financial losses that are a direct result of your injury. The most obvious of these are loss of earnings due to incapacity to work. This would include compensation if the medical evidence indicates that you are unlikely to work in the future. A pension loss calculation may also be appropriate.

You may be able to make a whiplash or passenger injury claims; motorbike & bicycle injury claims; public transport injury claims; and infant settlement claim. Our personal injury solicitors are here to support you during the entire recovery process and to assist in all your queries. In addition, we can also recover and claim for the time a loved one spends looking after you in the immediate aftermath of the accident. Treatment expenses, such as physiotherapy, CBT, prescription costs, unused gym membership, travel expenses to and from the hospital and damaged items of clothing also fall into this category.

This is not an exhaustive list. Our personal injury solicitor will discuss this extensively with you and make sure that all financial loss that can be recovered are included. These losses will be supported by documentary evidence. Please call our personal injury solicitors to find out if you can claim compensation at no cost to you.
